Terms & Conditions

Please read the following terms carefully before using our services. By engaging with 99ineTech you agree to these terms in full.

1 Acceptance of Terms

By accessing our website, requesting a proposal, or engaging 99ineTech for any service, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you are acting on behalf of a company, you represent that you have the authority to bind that organisation to these terms.

If you do not agree with any part of these terms, please do not proceed with using our services. Continued use of our website or services following any update to these terms constitutes your acceptance of the revised version.

2 Services We Provide

99ineTech offers a range of technology and digital marketing services including, but not limited to:

  • Website design and development
  • Mobile application development for iOS and Android
  • Custom software and SaaS product development
  • Cloud infrastructure setup and management
  • Search engine optimisation and growth marketing
  • Technical talent augmentation and staffing

The exact scope of any engagement is defined in a separate Statement of Work, proposal, or written agreement signed by both parties. In the event of a conflict between these terms and a specific project agreement, the project agreement takes precedence for that engagement.

3 Client Obligations

To allow us to deliver work to a high standard and on time, clients agree to:

  • Provide accurate, complete, and timely information, content, and materials required for the project
  • Make a designated point of contact available to review and approve deliverables within agreed timelines
  • Notify us promptly of any changes to project requirements, budget, or scope
  • Ensure that any third-party materials, logos, images, or content provided to us are owned by the client or properly licensed for use
Delays caused by late feedback, missing assets, or unclear approvals from the client side may impact delivery timelines. Any resulting timeline extension is not considered a breach of contract on our part.

4 Payments and Billing

Payment terms are outlined in each project agreement. General billing practices are as follows:

  • A deposit is typically required before project work begins, as specified in the project proposal
  • Milestone-based projects are invoiced at agreed checkpoints throughout the engagement
  • Retainer and ongoing services are billed on a monthly basis in advance
  • Invoices are due within 14 days of the issue date unless otherwise agreed in writing

Late payments may result in a pause of active work until the outstanding balance is cleared. 99ineTech reserves the right to charge a late payment fee of 2% per month on overdue invoices. All prices are quoted in US Dollars unless stated otherwise.

Refunds are assessed on a case-by-case basis. Work completed and delivered as agreed is generally non-refundable. If you have a concern about a payment or deliverable, contact us directly and we will work to resolve it fairly.

5 Intellectual Property

Upon receipt of full payment for a project, 99ineTech transfers ownership of the custom code, designs, and deliverables created specifically for that project to the client. This transfer applies to the final deliverables only.

The following remain the property of 99ineTech at all times:

  • Internal tools, frameworks, libraries, and methodologies used in the development process
  • Generic components, starter templates, and reusable code modules that are not unique to the client project
  • Work produced during the pitch or proposal phase that was not part of a paid engagement

Our name, logo, brand assets, and website content are protected. You may not reproduce or use them without our written consent. We reserve the right to reference your project in our portfolio and case studies unless you request otherwise in writing prior to project completion.

6 Confidentiality

Both parties agree to treat as confidential any non-public, proprietary, or sensitive information shared during the course of an engagement. This includes business strategies, technical specifications, financial data, and client lists.

If a formal Non-Disclosure Agreement is required, we are happy to sign one. Confidentiality obligations remain in place for two years following the end of a project unless a separate agreement specifies a different period.

Confidential information does not include information that is already publicly known, becomes public through no fault of the receiving party, or is independently developed without use of the disclosed information.

7 Warranties and Limitation of Liability

We commit to delivering our services with reasonable skill and care, and in line with the scope agreed in each project. We do not guarantee specific outcomes such as search engine rankings, revenue growth, or app store performance, as these depend on factors outside our direct control.

Our total liability in connection with any project is limited to the total fees paid by the client for that specific engagement in the preceding six months. We are not liable for indirect losses, loss of profit, loss of data, or consequential damages arising from the use of our services.

If any deliverable has a defect that falls within the agreed scope of work, we will make reasonable efforts to correct it within a mutually agreed timeframe at no additional cost.

8 Termination

Either party may terminate an ongoing engagement by providing 30 days written notice. For project-based work, termination mid-project requires the client to pay for all work completed up to the termination date, plus any non-recoverable third-party costs already incurred.

99ineTech may terminate immediately and without notice if a client engages in abusive behaviour toward our team, fails to pay outstanding invoices after repeated reminders, or requests work that violates applicable laws or regulations.

Upon termination, any deliverables completed and paid for will be handed over to the client. Deliverables not yet paid for remain the property of 99ineTech until payment is received.

9 Governing Law

These terms are governed by the laws of Pakistan. For clients based internationally, both parties agree to attempt to resolve any disputes through good-faith negotiation before pursuing formal legal action.

If a dispute cannot be resolved informally, it will be referred to binding arbitration in Lahore, Pakistan. Both parties agree to accept the outcome of that process as final.

10 Changes to These Terms

We may update these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or business practices. When we do, we will update the date shown at the top of this page.

We encourage you to check this page periodically. Continuing to use our services after an update means you accept the revised terms.
